General Overview
a) roseyefilm specialises in analog (35mm-film) photography related services; including travel, events, business, brand, portrait and product photography.
b) roseyefilm also offers limited edition film prints for purchasing.
c) By purchasing or using our products/services, you agree to the following terms and conditions.

Intellectual Property & Copyright
a) All images, text, and content on this website are the property of roseyefilm photography.
b) Images may not be copied, downloaded, screenshot, printed, or reproduced without permission unless a license or purchase agreement is in place.
c) Purchasing a print or digital image does not grant ownership of copyright unless stated.

Booking, Deposit & Payment Terms
a) All invoices are issued electronically via email. Payments are accepted by bank transfer or direct debit using the payment options provided on your invoice.
b) A 50% non-refundable booking deposit is required within 48 hours of receiving your invoice, which secures your booking.
c) Bookings deposits are non-refundable.
d) The remaining balance must be paid in full no later than seven (7) days prior to your scheduled session or event date.
e) Full payments not received by the due date specified on your invoice will result in your booking being cancelled or your gallery delivery being delayed.
f) All payments are processed securely through trusted third-party providers. We do not store or have access to your full credit card details at any time.

Product Usage Disclaimer
a) roseyefilm cannot guarantee image outcomes due to variables in shooting, handling, and development.
b) roseyefilm photographs using professional 35mm film. As film is a handmade analogue medium, natural characteristics including grain, colour shifts, light leaks, exposure variations and other imperfections may occur. These are considered part of the artistic style and are not regarded as faults.

Shoot Turnaround Time
a) Development and scans will be electronically delivered via email link within 1-2 weeks from the shoot.
b) Photography Prints (if purchased) will be shipped within 1-2 weeks, or, if able to be arranged and hand delivered within 1 week of ordering (local to Sydney CBD area only).

Digital File Delivery
a) Photos and scans are electronically sent via a private Google Drive link within 1-2 weeks.
b) Link will be active for three weeks only, please download your files before then.
c) Files will be high-resolution JPEGs, suitable for print.

Liability Limitation
a) roseyefilm is not responsible for lost or damaged film in transit, camera malfunctions, missed shots or error users.
b) roseyefilm always strives for care, but film is an analog medium and results can vary.

Cancellations
a) A minimum of 14 days notice is required to be eligible for a full deposit refund.
b) Cancellations made within 7 days of the event are not eligible for a refund.
c) roseyefilm reserves the right to reschedule should any of the following situations arise:
- Equipment Malfunction/Technical Issues (that cannot be resolved on site)
- Venue or Location Issues (e.g. location becomes unavailable, unsafe or unsuitable for filming)
- Weather related events (e.g. Floods, Inclement Weather, Electrical Storms, Power Outages)
- Public Safety Concerns (e.g. Protests, Unsafe conditions, Local emergencies)
- Legal or Permit Issues (e.g. Required filming permits denied or revoked)
- Personal Illness or Medical Emergencies (that prevent the photographer from safely or effectively performing the session)
- Scheduling Conflicts (that may arise due to full-time work commitments)

In such cases, clients will be contacted immediately when a rescheduling need arises. An alternate date will be offered within a reasonable timeframe. If a mutually agreeable date cannot be found, roseyefilm may issue a credit towards a future session.

Travel Fees
a) Travel fees are not included in the standard package price and will be calculated based on the distance from roseyefilm’s base location.
b) Travel fee will be added onto the final quote.
c) Any applicable tolls, parking, or accommodation (if required) will also be added to the final invoice.

Late Arrival
a) Clients are asked to arrive on time for their scheduled session. Late arrival may reduce the available photography time. Arrivals exceeding 20 minutes without prior notice will be considered a cancellation.

Usage Rights
a) Personal usage rights are extended to all clients booking event services.
b) roseyefilm retains all copyrights.
c) Please credit roseyefilm when posting online through social media.
d) All sold photography prints and digital downloads are intended for personal use only and may not be reproduced, distributed, or used for commercial purposes without prior written permission.
e) Images may not be used for commercial purposes, advertising, resale or publication without written permission from roseyefilm.

Use of Images
a) roseyefilm may use photographs from your session for portfolio purposes, including the website, social media platforms, printed marketing materials, publications, competitions, exhibitions, and paid advertising. If you would prefer your images not be used for promotional purposes, please notify roseyefilm in writing via email prior to your session. Your privacy will be respected, and your images will not be published.

Privacy Policy
a) roseyefilm will only use your email address/information for order-related communication or updates, which will never be made public.
b) No data is sold or shared with third parties.

Copyright
a) Copyright of all photographs remains the exclusive property of roseyefilm in accordance with the Copyright Act 1968 (Cth).
Clients are granted a non-exclusive, non-transferable licence to use their images for personal purposes only, including downloading, printing, and sharing on personal social media accounts. Copyright remains with roseyefilm. Images may not be sold, edited, used for commercial purposes, or provided to third parties without prior written permission.
